And we’re seeing that now in a covert attack by Donald Trump’s administration that directly targets the Constitution, private property rights, and the rule of law.
The intention of the Constitution was to reserve certain powers to the state governments. State legislators are supposed to pass laws for the health, safety, and welfare of people living in the state. And those laws are enforced by local police.
Things were set up this way to limit the power of the federal government. And also to give citizens of the United States choices about which policies they lived under. If you don’t like the way your state is running things, then you have the freedom to move to a different state that is governed more to your liking.
So what is Trump doing that’s an attack on this set-up?
It has to do with asset seizure in criminal cases. In some states, it’s legal for law enforcement officials to seize the assets of a suspected criminal. Think about that for a moment. If you’re suspected of a crime, in some states, that’s enough for the government to take your house, your bank account, everything.
Some states recognize that this is not good. They’ve made it illegal to seize assets until a suspect has stood trial and been convicted. Obviously, a better policy if you value liberty and see the wisdom in constraining the government.
So what does the fed do? It goes to the local police departments in states with the stronger laws against asset seizure and says to go ahead and seize assets prior to trial under looser federal laws and the feds will split the assets with the police doing the seizing.
